Membership Terms

OVERVIEW

Memberships continue indefinitely and you will continue to be charged unless and until you cancel your Membership, or we suspend or terminate your Membership in accordance with these Membership Terms and/or the Yearly Pressie Terms of Use and Sale.

By signing up for a Membership (“Membership”), you agree to these Membership Terms (“Membership Terms”) as well as our Terms of Use and Service (“TOUS”), which are incorporated herein by reference, and you agree to abide by such other Yearly Pressie policies, guidelines and rules that may be applicable to your Membership activities from time to time.

1. A Membership. A “Membership” consists of an initial registration and the associated fee per requested number of Recipients (“Recipient,” “Recipients”). Thereafter, your Membership provides your explicit consent for Yearly Pressie to charge your payment method of choice for your selected membership fee once a year ($30.00 USD for a package of 1-2 recipients; $70 USD for a package of 3-5 recipients; or $135 USD for 6-10 recipients) and for the additional Gift (“Gift”) charge, purchased on your behalf and at your direction, for each Recipient. Each Gift sent on your behalf to a Recipient is it a Gift Event (“Gift Event”). 

The Yearly Pressie Membership is an ongoing subscription service that automatically charges you at your selected Membership level ($30.00 USD for a package of 1-2 recipients; $70 USD for a package of 3-5 recipients; or $135 USD for 6-10 recipients) each year to your payment method of choice. Your Membership provides your explicit consent for Yearly Pressie to keep your payment method on file and charge it as directed by this Membership Agreement. Unless and until you cancel your Membership, you will be charged at the beginning of each year and for every Gift sent on your behalf thereafter on the applicable date specified in our billing and shipping schedule (“Bill Date").

2. A Gift Event. Your Membership is your explicit consent for Yearly Pressie to purchase and ship Gifts within your preselected price range and send them to your designated Recipients at your designated frequency (birthday and/or holiday(s)). Each Gift will be charged to you at or about the manufacturer or distributor’s suggested retail price (market suggested retail price “MSRP”). Each Gift sent on your behalf to a Recipient is it a Gift Event (“Gift Event”). Your Membership is your explicit consent for Yearly Pressie to charge your payment method of choice for each and every Gift Event on the applicable date specified in our billing and shipping schedule (“Bill Date"). Charges for a Gift Event include charges for the Gift within your preselected price range, as well as any applicable shipping and handling charges, taxes, credit card fees, or other fees incurred by Yearly Pressie during or related to Gift Event transactions.  

The specific date of your first shipment is dependent on your Recipient’s information and your selected Gift Event dates. Yearly Pressie reserves the right to begin Gift Events for new Memberships three (3) months after the Membership is created, activated, and paid for. Thereafter, Yearly Pressie is an ongoing subscription service that automatically charges your payment method of choice for each Gift Event and annual Membership fee. 

Your Membership provides your explicit consent for Yearly Pressie to keep your payment method on file and charge it as directed by this Membership Agreement. Unless and until you cancel your Membership, you will be charged at the beginning of each year and for every Gift sent on your behalf thereafter on the applicable date specified in our billing and shipping schedule (“Bill Date").

3. Notifications and Additional Consents. You will be notified by email at least 10 business days prior to the finalization of a Gift Event. This email will include the proposed Gift as well as confirmation your Recipient’s information. Should you wish to make any changes to these details please follow the link within the email, log into your account on YearlyPressie.com, or email support@yearlypressie.com. Failure to make any changes or contact Yearly Pressie within 3 business days of receiving said email will amount to your confirmation and explicit consent for Yearly Pressie to continue with the Gift Event. This consent provides Yearly Pressie with the right to charge your stored payment method of choice for the Gift as well as any applicable shipping and handling charges, taxes, credit card fees, or other fees incurred by Yearly Pressie during or related to Gift Event transactions. 

4. Guest access. From time to time, or at no time, Yearly Pressie may offer temporary access to some or all of its Sites or Services to certain non-members. In addition to other features, guests may have access to purchase items from certain Yearly Pressie advertised products or Gifts in accordance with these Membership Terms and our TOUS. Guest access does not provide you with a Yearly Pressie Membership. Guests will not benefit from Gift Events unless they sign up for a Membership. Yearly Pressie may revoke, limit or modify guest access at any time.

5. Taxes and Shipping and Handling and Fees. Stated prices for Memberships, Gifts, and other products or services available for purchase through your Membership or otherwise on our websites (including through Add-Ons, Edit or other sales events) do not include any customs, duties, sales, use, value-added, excise, provincial, federal, state, local or other taxes, or credit card and processing fees. You are solely responsible for the payment of such taxes related to your purchase. We have the right to charge you for any taxes that we believe we are required to pay or collect related to your purchase. Please also note that shipping and handling fees are not included in the stated prices.

Your Gift will generally ship within 30 days of billing. Once your Gift has shipped, it will generally be delivered within 14 business days. Delivery times are dependent on the shipping carrier, the retailer distributing the gift, and subject to change.

6. Cancellation Policy. Memberships may generally be cancelled any time, subject to these TOUS and the specific Membership terms. In order to cancel your Membership, you must do one of the following: (a) email us at support@yearlypressie.com, indicate that you wish to cancel your Membership, and follow the instructions that we send you in response; or (b) log in to your Yearly Pressie account, navigate to the “Account” link, click on the “Profile” tab, choose “Cancel Membership”, and follow the instructions.

There are no cancellation fees. Cancellations must be effected prior to your next Bill Date to avoid further charges. Cancelling your Membership does not provide you a refund for Membership payments already processed, nor does it stop a pending charge.

7. Termination/Program Changes. Yearly Pressie reserves the right to terminate a Membership for Member nonpayment, fraud or abuse of their Membership, violation of any state or federal law, and/or violation of these Membership Terms, the TOUS, or any other Yearly Pressie guidelines (including the Community guidelines) or as otherwise provided in the TOUS. Members must always treat all other Yearly Pressie Members and staff with respect. Attacks, harassment, negative references, offensive comments, profanity, threats, bullying, or otherwise inappropriate comments or behavior are not allowed. If Yearly Pressie suspects that these Membership Terms, the TOUS, or any other Yearly Pressie guidelines are being violated, Yearly Pressie may take any appropriate action including but not limited to termination of your Membership and account.

Yearly Pressie may terminate or modify the Membership program, including its Membership Terms, the type or number of Memberships, recipient offerings, prices and discounts on product and gift offerings, eligibility used to determine discount amounts, order frequency, billing dates, delivery dates, fees, taxes, shipping fees or dates or any other features, at any time. Any modifications will go into effect immediately and will apply to your future orders. Your continued participation in the program constitutes your acceptance of any modifications. If you do not agree to any changes, you must cancel your Membership and/or other order(s).

8. Disputes. As stated in Section 14 of our TOUS, which are incorporated herein by reference, You and Yearly Pressie agree that any dispute, claim, or controversy, whether based on past, present or future events, arising out of or relating in any way to: these Membership Terms and any incorporated agreements (e.g. the TOUS), and any prior versions thereof (including the breach, termination, enforcement, interpretation or validity thereof); the Services or Sites; content or Products currently or previously available on or through the Services or Sites; your relationship with Yearly Pressie; your information provided to Yearly Pressie; the threatened or actual suspension, deactivation, or termination of your Membership or access to the Services or Sites; payments made by you or payments made or allegedly owed to you; any promotions, credits, or other offers; and/or any other federal and state statutory and common law claims (collectively, “Covered Matters”) will be resolved in accordance with the provisions set forth in Section 14 of the TOUS.

9. Severability. If an arbitrator or a court of competent jurisdiction finds any provision of these Membership Terms to be invalid, the parties agree that the arbitrator or court should endeavor to give effect, to the maximum extent permitted by law, to the parties’ intentions as reflected in the provision, and the other provisions of these Membership Terms will remain in full force and effect.
